2.1 Membership Agreement

When you purchase a membership with Boxanetic, you are entering into a binding agreement subject to the terms outlined herein. Membership fees and benefits are as described on our website or in your membership contract.

All memberships are personal to the member and cannot be transferred or assigned to another person unless specifically approved by Boxanetic management. We reserve the right to revoke or deny membership at our discretion.

2.2 Class Bookings and Cancellations

Classes must be booked in advance through our online booking system, mobile app, or in person. Class availability is subject to capacity limits and scheduling changes.

Cancellation Policy:

• Cancellations made more than 12 hours before a scheduled class will not incur any penalty.
• Late cancellations (less than 12 hours before the class) may result in the deduction of a class credit or a late cancellation fee.
• No-shows will result in a full charge for the class or deduction of a class credit.
• We reserve the right to modify this cancellation policy with reasonable notice to members.

2.3 Payment and Billing

Membership fees are due in advance and will be automatically charged to your designated payment method according to your membership agreement (e.g., monthly, quarterly, or annually).

If a payment is declined or returned, we reserve the right to charge a reasonable administrative fee and suspend your membership until payment is successfully processed. Consistent payment failures may result in termination of your membership.

We reserve the right to adjust membership fees with reasonable notice to members. Such notice will be provided at least 30 days before the new rates take effect.

3.1 Health Declarations

By participating in our classes or using our facilities, you represent and warrant that:

• You have no medical conditions that would prevent you from safely engaging in physical activity.
• You have consulted with a physician before beginning any exercise program if you have any health concerns.
• You will promptly inform our staff of any changes to your health that may affect your ability to safely participate.
• You understand that participation in physical activities carries inherent risks.

We reserve the right to request a medical clearance from a healthcare provider if we have concerns about your ability to safely participate in our activities.

3.2 Facility Rules

While using our facilities, you agree to:

• Follow all posted rules and instructions from staff.
• Use equipment properly and only for its intended purpose.
• Clean equipment after use with provided sanitizing materials.
• Wear appropriate fitness attire and footwear.
• Respect the personal space and experience of other members.
• Not attend if you are unwell, especially with contagious conditions.

We reserve the right to ask any member to leave if they are not complying with our rules or if their behavior disrupts others' experiences.

4.1 Account Security

If you create an account on our website or booking system, you are responsible for:

• Maintaining the confidentiality of your password and account information.
• All activities that occur under your account.
• Promptly notifying us of any unauthorized use or security breaches.

We reserve the right to terminate accounts that violate our Terms or are inactive for extended periods.

4.2 Intellectual Property

All content on our website, including text, graphics, logos, images, videos, and software, is the property of Boxanetic or our content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, display, or use our content without our express written permission. The Boxanetic name, logo, and related marks are trademarks of our company.

4.3 User Content

If you submit content to our website (such as reviews, comments, or social media posts tagged with our handles), you grant us a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, and display such content for any purpose.

You represent that you own or have the necessary rights to any content you submit, and that your content does not infringe upon the rights of any third party.

5.1 Assumption of Risk

You acknowledge that physical activities, including but not limited to yoga, pilates, aqua fitness, tai chi, and meditation, involve inherent risks of injury, illness, or death. By participating in our classes or using our facilities, you voluntarily assume all such risks.

5.2 Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that our website or services will be uninterrupted, secure, error-free, or free from viruses or other harmful components.

5.3 Limitation of Liability

To the fullest extent permitted by applicable law, Boxanetic, our directors, employees, partners, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your participation in our classes or use of our facilities.
• Your access to, use of, inability to access, or inability to use our website or online services.
• Any unauthorized access to or use of our secure servers or personal information stored therein.
• Any interruption or cessation of transmission to or from our website.

In no event shall our total liability for all claims related to our services exceed the greater of $100 AUD or the amount you paid to us during the six months prior to the claim.

6.1 Membership Cancellation by Member

You may cancel your membership by providing written notice according to the terms of your membership agreement, typically requiring 30 days' notice before the next billing cycle. Cancellation requests must be submitted via email or through our member portal.

Early termination of fixed-term memberships may incur cancellation fees as specified in your membership agreement, except in cases of:

• Medical incapacity (with supporting documentation from a healthcare provider).
• Relocation to an area more than 25km from our facilities.
• Other circumstances at our discretion.

6.2 Membership Suspension

Members may request a temporary suspension of their membership for the following reasons:

• Extended travel (minimum 4 weeks, maximum 12 weeks per year).
• Medical conditions (with supporting documentation).
• Financial hardship (at our discretion).

A suspension fee may apply as specified in your membership agreement. Requests must be submitted at least 7 days before the suspension period.

6.3 Termination by Boxanetic

We reserve the right to terminate or suspend your membership immediately and without notice if:

• You breach these Terms or your membership agreement.
• You engage in conduct that is harmful to others or disruptive to our operations.
• You provide false or misleading information.
• You fail to make required payments.

We may also terminate our services generally, or discontinue particular features, with reasonable notice to members.

11.1 Entire Agreement

These Terms, together with any other agreements or policies referenced herein, constitute the entire agreement between you and Boxanetic regarding your use of our Services and supersede all prior agreements and understandings.

11.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

11.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by our authorized representative.

11.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.
